1.About these terms
These terms are an agreement between you and OXCRED (PTY) LTD, a company registered in South Africa ("we", "us" or "our"). They cover the Hoptick app, listed on Google Play as "Hoptick: To-Do List & Habits", and this website.
By downloading, installing or using Hoptick, you agree to these terms. If you don't agree, please don't use Hoptick.
Our privacy policy explains what happens to your information. When you buy something in Hoptick, Google Play's terms also apply to the payment.
Please read sections 8 and 15 carefully. Section 8 explains that Hoptick isn't medical advice, and section 15 limits our responsibility to you as far as the law allows.
2.Who can use Hoptick
You can use Hoptick if you're 13 or older. If you're under 18, please ask a parent or guardian before you buy Premium or start a free trial.
We give you a personal, non-exclusive right to install and use Hoptick on your own Android devices, for your own use. You can't pass this right on to anyone else. Hoptick is licensed to you, not sold.
3.Your data and backups
Hoptick doesn't need an account. Your tasks, habits, notes, progress and rewards are kept on your device, not on our servers. That means we can't see them, and we can't get them back for you.
If you uninstall Hoptick, clear its data, or lose or reset your phone without a backup file, your data is lost for good. You can make a backup file in Hoptick's settings at any time, and Premium can also make backups automatically on your phone. Keep your backup files somewhere safe and private, and make a fresh one before you change phones.
What you write in Hoptick is yours. Please don't store passwords, bank details or other sensitive information in it.
4.Premium
Hoptick is free to use. Premium unlocks extra features, which the app lists before you buy. It comes as a yearly plan. For a limited time after launch, it's also available as Lifetime, a one-time purchase.
- Premium is linked to the Google account you bought it with. On a new phone signed in to the same Google account, you can restore it at no cost.
- Lifetime is a one-time payment. It unlocks every Premium feature that runs on your phone, now and in future, for as long as we offer Hoptick, with nothing to renew or cancel.
- Future features that run on our servers and cost us money every month, such as syncing between devices or cloud backup, will come with the yearly plan only, not with Lifetime. The app says this before you buy Lifetime.
- We may add new features to Premium over time.
The yearly plan
- It renews automatically every year, at the price Google Play showed you, until you cancel. Google Play charges you on each renewal date.
- Free trial: if you're offered one, you can cancel at any time during the trial and you won't be charged. If you don't cancel, the yearly plan starts and Google Play charges you when the trial ends. Hoptick reminds you 2 days before it ends, if you allow notifications. Trials are for new subscribers only, once per Google account.
- Cancelling: cancel any time in Google Play (Payments and subscriptions, then Subscriptions), or from Settings, Premium, Manage in Google Play in Hoptick. Uninstalling Hoptick doesn't cancel it. After you cancel, Premium stays on until the end of the year you've paid for.
- Price changes: if we change the yearly price, Google Play tells you before it applies to your next renewal, and in some countries asks you to agree first. You can cancel before it applies.
- When Premium ends: nothing you made is deleted. Features beyond the free plan stop until you subscribe again. For example, habits past the free 7 keep working, but you can't add more.
5.Prices, payments and refunds
- Google Play shows the price in your currency before you pay. Prices can differ from country to country, and Google Play adds any tax your country requires.
- Google Play takes the payment. We never see your card or bank details.
- We may change prices or run offers, such as the Lifetime launch offer, which is available for a limited time only. A later price change or offer never changes a Lifetime purchase you've already made. Yearly price changes work as described in section 4.
- Refunds: you can ask Google Play for a refund under Google Play's refund policy. If something isn't working, or you bought Premium by mistake, email us at support@oxcred.co.za and we'll help where we can. If a purchase is refunded, Premium is switched off again. Cancelling a yearly plan stops the next renewal; it doesn't refund the current year, unless Google Play's refund policy or your consumer law says otherwise.
- Nothing in these terms takes away a right to cancel or get a refund that you have under consumer law, including South Africa's Consumer Protection Act and Electronic Communications and Transactions Act.
6.Rewards in the app
Hoptick has game rewards: XP, levels, awards, clovers, skip tokens, and scenes and frames for your rabbit. They're there to make building habits more fun.
- They're earned by using the app. We never sell clovers for real money.
- They have no cash value. They can't be sold, swapped for money or moved to another person, and they aren't your property.
- Rewards unlocked at certain levels are free gifts.
- We may change how rewards are earned, or what things cost in the shop, to keep the game fair and fun.
- They're kept on your device with the rest of your data, so they're lost if your data is lost without a backup.
- Your own rewards (the treats you set up in My rewards, such as "Coffee out") are your own. Hoptick keeps track of them for you; we don't provide, pay for or promise them.
7.Reminders, holidays and the timer
- Reminders depend on your phone. Battery savers, Do Not Disturb, missing permissions or the phone's own settings can delay or stop them. Please don't rely on Hoptick alone for anything important, such as taking medicine, appointments or deadlines.
- Public holidays come from public sources and our own corrections. Dates can be wrong or change at short notice. The long weekend planner only makes suggestions, so check with your employer before you book leave or travel.
- The focus timer is for focus and routines. Don't use it where a wrong time could cause harm.
8.Health and wellbeing
Hoptick helps you build habits. It isn't medical, health, fitness or mental-health advice, and the rabbit's encouragement isn't professional guidance.
Before you make a big change to your diet, exercise, medicine or sleep, or try to quit something like smoking or alcohol, talk to a doctor or another qualified professional. If you ever feel unwell or unsafe, please contact a health professional or your local emergency services.
9.Sharing pictures
Hoptick can make a picture of your rabbit, your week or a streak for you to share. Task names are never included, and habit names only when you switch them on.
You choose what to share and who sees it. Once you share a picture, the app you share it to (such as WhatsApp or Instagram) and its terms apply, and we can't remove it for you.
10.Fair use
When you use Hoptick, please don't:
- copy, sell, rent or give away the app, or its pictures, animations or sounds, outside the app;
- change, decompile or reverse-engineer the app, except where the law allows it;
- use Hoptick to break the law, or to harm, harass or mislead anyone;
- try to interfere with our website, or with the files Hoptick downloads from it;
- use the Hoptick name, the rabbit or our logo in your own products or ads without our written permission.
Sharing the pictures Hoptick makes for you, for personal use, is always fine.
11.Our content and yours
Hoptick, its rabbit, pictures, animations and sounds, the Hoptick name and logo, the app's design and code, and this website belong to OXCRED (PTY) LTD or to the people who license them to us. Hoptick also uses open-source software and fonts under their own licences.
Your tasks, habits and notes belong to you. We don't claim them, and they stay on your device.
If you send us ideas or feedback, we may use them to improve Hoptick without owing you anything for them.
12.Services run by others
Hoptick relies on some services we don't run, such as Google Play (downloads, payments and refunds), your phone's speech recognition for voice tasks, and public holiday data. These services have their own terms, and they may change or stop. We're not responsible for services we don't control, but we'll try to keep Hoptick working if one of them changes.
Hoptick also downloads a few small files from our website: holiday date corrections, new monthly scenes for the shop, and the list of our other apps. These downloads never send your tasks or habits.
13.Changes to Hoptick and to these terms
We keep improving Hoptick, so we may add, change or remove features. If we ever have to remove a feature you paid for (for example because of a new law, a security problem, or a service it relies on closing), we'll try to offer something that works as well.
We may update these terms from time to time, and the date at the top shows when they last changed. If a change matters to you, we'll let you know in the app or with a notice on this page before it takes effect. If you keep using Hoptick after that, the new terms apply. If you don't agree with them, you can stop using Hoptick (make a backup first if you'd like to keep your data).
14.Stopping
You can stop using Hoptick at any time by uninstalling it. Uninstalling deletes the data on your device unless you've made a backup.
If you seriously break these terms, your right to use Hoptick ends. Sections 11, 15, 16 and 17 still apply after that.
15.Our responsibility to you
We work hard to make Hoptick reliable and safe, but we can't promise it will always be free of errors, never interrupted, or right for every need. To the fullest extent the law allows:
- we're not responsible for lost data (please keep backups), reminders that didn't arrive, wrong holiday dates, or decisions you make based on the app;
- we're not responsible for indirect or knock-on losses, such as lost income, lost opportunities or missed events;
- our total responsibility to you for all claims about Hoptick is limited to the greater of R100 and what you paid for Premium in the 12 months before the claim (or the Lifetime price, if you bought Lifetime).
Nothing in these terms limits our responsibility where the law doesn't allow it to be limited, for example for gross negligence or fraud, and nothing takes away your rights under consumer law, including South Africa's Consumer Protection Act.
16.The law and disputes
These terms are governed by the law of the Republic of South Africa. If something goes wrong, please email us first: most problems can be sorted out quickly. If we can't resolve it together, the South African courts will decide.
If you live outside South Africa, you keep any consumer protection your own country's law gives you, including any right to bring a claim in your local courts.
17.General
- These terms and our privacy policy are the whole agreement between you and us about Hoptick.
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- We may transfer this agreement to a company that takes over Hoptick. Your rights under these terms stay the same.
18.This website
This website tells you about Hoptick. Its words, pictures and animations belong to us; you're welcome to look around and to share links to it. We try to keep it accurate, but features and availability can change, and what Google Play and the app show when you buy is what counts. Our privacy policy explains how we handle information.
